MEMBERSHIP AGREEMENT
Kindly read the following Terms thoroughly, which might be updated every so often by NuYu Fitness. These terms clarify the rights, and the assignments of you, and of NuYu Fitness. The updates to these Terms will be notified via written notice to you.
ACCEPTANCE OF TERMS OF USE
By accessing and using Nuyu services and facilities operated by NuYu Fitness, you accept and agree to commit to these terms.
PAYMENT TERMS
- You can choose your preferred payment method and select the most suitable membership type for you. Accepted payment methods include cash, debit card, and credit card. All memberships must be paid in advance at the time of purchase, and no deferred payment is allowed.
- Payment must be made in advance for all other additional programs, including Personal Training, Pilates Reformer workout and Online Personal Training. Fees should be paid at the reception desk or online if it’s necessary, and direct payment to the trainer is not permitted under any circumstances.
- Membership fees are non-refundable under any circumstances. The management retains discretionary authority to consider exceptions.
- Installment payments are allowed only through installment services: Tabby &Tamara, approved by the management.
- Transfer of ownership, or transfer from one club to another club will be allowed with an additional fee paid only at the branch.
MEMBERSHIP PROCEDURES
- Fill in the subscriber’s form with your personal details. The management commits not to disclose any information about the subscriber to any external parties outside our institution.
- Conduct a guided tour of the club’s services and facilities.
- The subscriber must review the membership agreement details, and sign acceptance, should the purchase be made in the store or online via website.
- Complete the payment process subject to the terms and conditions.
- The subscriber receives the payment invoice automatically via the registration email once the purchased has been done.
MEMBERSHIP OUTSET
- Membership automatically begins upon completion of the enrollment procedure.
- The start date of membership can be postponed for a maximum 30 days from the purchase date.
TYPES OF FREEZING
- The subscribers have the right to take a temporary break from their upfront paid membership, according to the duration of the membership.
- 3M Membership: Total 14 days freeze duration, consumed in 2 requests, 7 days freeze for each request.
- 6M Membership: Total 60 days freeze. The first 30 days are free and should be consumed in 4 request maximum. The additional 30 days are paid at a fee of SAR 207 and should be consumed in 4 requests maximum and 7 days minimum freeze for each request.
- 12M Membership: Total 90 days freeze. The first 60 days are free and should be consumed in 8 request maximum. The additional 30 days are paid at a fee of SAR 173 and should be consumed in 4 requests maximum and 7 days minimum freeze for each request.
- 18 M Membership: Total 90 days freeze. The first 60 days are free and should be consumed in 8 request maximum. The additional 30 days are paid at a fee of SAR 173 and should be consumed in 4 requests maximum and 7 days minimum freeze for each request.
- Subscribers are not allowed to freeze any memberships with less than 30 days left before expiry.
- Pregnancy freeze – pregnant ladies should present a medical report that states clearly their inability to exercise in order for them to freeze for free. In the absence of such report, freezing is deducted from her allowance and the rest can be paid.
FREEZING PROCESS
- The subscriber may freeze their membership via community email by providing all the details regarding the type of membership, and identifications as well.
- The subscriber personally freezes their membership at reception desk after filling out the freezing form and receiving a copy of the freezing form. This form is the only recognized document within the club in case of any objections to the freezing later.
- The subscriber may freeze their membership via phone/ WhatsApp text message by providing the receptionist with their mobile number. Proof of the communication needs to be recorded for future reference.
- Retroactive freezing of the membership is not allowed at all.
- Medical Reasons: in case of illness, a medical report stating the full diagnosis and reasons to suspend contract during illness is needed to process freezing for medical reasons
MEMBERSHIP REACTIVATION AFTER FREEZING
- The membership is automatically reactivated after the freezing period ends.
- If the subscriber wants to end the freezing period earlier, they must personally visit the reception desk, and reactivate their membership without adding the previously frozen days to their remaining balance.
TRANSFER OF OWNERSHIP
- There is a membership transfer fee of 350 Riyals that needs to be paid before starting the transfer procedures at the club.
- Transfer the ownership of free months it’s not allowed
- It’s not allowed to transfer any membership with the remaining duration of 30 days or less.
- It’s not allowed to transfer a membership to an active member of the club.
- An upfront paid membership can only be transferred once, from the original buying member to another person. The other person cannot transfer it again to someone else.
TRANSFER FROM A CLUB TO ANOTHER CLUB
- There is a club transfer fee of 173 Riyals to be paid before starting the transfer procedure at the club.
UPGRADE
- The subscriber can upgrade their membership to a longer duration within 30 days of activating their membership with an additional fee according to the duration of the upgraded membership.
PRICES
- Membership fees are subject to change without prior notice. The prices include value-added tax (VAT), and terms and conditions apply.
CLUB OPERATING HOURS
- The club operating hours are available at the entrance, and on the website.
- Operating hours are subject to change during official holidays, and we commit to notify subscribers of any changes in advance.
- Schedules are subject to change without prior notice in case of necessity.
MAINTENANCE WORK & TEAM TRAINING
- The club reserves the right to close the facility during periodical maintenance and staff training, to ensure the highest health and safety standards.
PRODUCTS AND SERVICES- GROUP FITNESS CLASSES
- We require that the subscribers read and respect the following rules for the purpose of ensuring a safe and effective training in our group training program.
- For Group Exercise classes, members will be allowed to book maximum 3 classes, 2 days in advance. To attend the classes, booking via NuYu App is mandatory.
- Not showing up to a class previously booked, and without cancelling the booking window with 2 hours prior the class start, will count as a walk-out. 3 walkouts within a period of 30 days will result in not allowing the customer to book any class for two weeks, and the duration can increase if the action is repeated.
- In case the class capacity is reached, a waiting list will be open for registration.
- The booking can be canceled 2 hours prior to the start of the class. After that time the cancellation will not be accepted.
- Mobile phones are allowed in the studios but should be kept aside, only for emergency use.
- Be on time: at least 5 minutes before the start of the class.
- It is not allowed to enter a class that has already started namely when the group of participants initiated the warmup, the first part of the class.
- During the class follow the exercises proposed by the instructor for safety reasons. You are not allowed to improvise.
- Interior training sport shoes are required
- Inform the instructor before the class starts if you need to leave early, in order to leave without disturbing the rest of the subscribers.
- Walking barefoot from the changing area to studios, or gym floor is not permitted.
- Use a small towel during the workout for hygienic reasons.
- The trainer must be aware if you have any health conditions, or if you are pregnant.
- At the end of the class, you need to return the equipment that has been used to its place.
- For any comments regarding the class that needs to be shared with the instructor, must be discussed after class ends.
PRODUCT AND SERVICES- PERSONAL TRAINING
- Personal Training fee will be paid separately from your membership and is not transferable or refundable.
- No Compensation will be given for any sessions that are missed or cancelled beyond the cancelation time, which is 12 hours before the session time (Terms and conditions apply).
- All the packages start not later than within 7 days after the purchase date (Terms and conditions apply).
- Each session of personal training has a 60-minute duration starting from the specified booking time.
- Based on the package purchased, all the sessions must to be completed on/or before the contract expires. Bellow timelines:
- One session – within 48 hours
- 5 sessions – within 35 days
- 10 sessions – within 50 days
- 15 sessions – within 70 days
- 20 sessions – within 90 days
PRODUCT AND SERVICES- PILATES REFORMER
- Pilates Reformer fee will be paid separately from your membership and is not transferable or refundable.
- No Compensation will be given for any sessions that are missed or cancelled out of the cancelation time, which is 12 hours before the session time (Terms and conditions apply).
- All the packages start not later than within 7 days after the purchase date (Terms and conditions apply).
- Each session of Pilates Reformer has a 60-minute duration starting from the specified booking time.
- Based on the package purchased, all the sessions must to be completed on/or before the contract expires. Bellow timelines:
- One session – within 48 hours
- 5 sessions – within 35 days
- 10 sessions – within 50 days
REFUNDS
- Subscribers cannot cancel their membership and ask for a refund of membership fees at any case after 48 hours from purchase, or if they have already used the facilities, products, and services.
AGE RESTRICTIONS
- The minimum age, or age group allowed to join the fitness club is 14 years old.
CLUB ACCESS
- The club can be accessed based on the type of membership you have chosen. If you have a Plus Membership, you can use any NuYu Sports clubs across the Kingdom. If you have a Standard membership, you can only use the home club. You need to make sure before joining that, you are aware about all the memberships options, and which club your membership allows you to access.
- The subscribers are required to present their barcode through NuYu Application on each visit to the club. There will be an access control system to help track your visits and minimize misuse. The Application Sign-In and Password cannot be transferred to another person including family and friends.
GENERAL RULLES, TERMS, AND INSTRUCTIONS
- Ensure appropriate clothes and sports shoes.
- Follow the safety rules and ask for the trainer assistance when needed while using the fitness equipment.
- The club management it is not responsible for any injuries sustained by subscribers, or visitors during the physical activities but will do the necessary to assist in such situation.
- Maintains order and cleanliness of the place.
- Last entry to the club must be 60 minutes before closing time
- Customs and traditions of Saudi Arabia as well as the club rules must be always respected. The club has the right to cancel any subscriber’s membership if the subscriber fails to obey to rules and regulations.
- Follow the guidelines for proper use of the equipment and ask for the trainer’s advice to ensure correct usage of machines.
- Mobile phones are allowed in the studios but should be kept aside, only for emergency use, in case of any damage the subscriber will be fully responsible
- Respect the privacy and the rights of other subscribers during workout sessions.
- It is not allowed to bring food in the club, except for water bottles
- Lockers are available for individual use. Subscribers must ensure the looker is securely closed before going to the club facilities. The locker and its contents are fully under the subscriber responsibility during the time spent in the club.
- All subscribers must show respect to the whole NuYu team.
- The club management is not responsible for any loss or damage to personal belongings of subscribers or visitors.
- Smoking is prohibited in and around the club
- It is forbidden to take visitors or children to the club
- Photography is strictly prohibited
- The club management reserves the right to limit the number of active members
- It is not allowed to offer the club staff any personal gifts or money.
- The subscriber must receive an invoice in relation to any amount paid via registration email, the invoice being the only document approved by NuYu Sports. The subscriber is responsible in the event of not receiving the invoice.
- The subscriber is not allowed to claim the unused days if the service is available
- The club has the right to limit or change working hours
- The club has the right to play music
- The subscriber will have to check-in in the club with the barcode of the NuYu Application.
- The subscriber will have to book for the chosen classes through the NuYu Application.
- It’s not allowed to join the class after 5 minutes from the start of the class.
- The subscriber must inform the instructor before the class starts in case of any injuries in order to assist with appropriate exercise.
- The subscriber must return the weights and other equipment to their designed places after use.
- The subscriber must use towels during the classes, and on the gym floor as well
COMMUNICATION
- We would like to extend our services by offering help and advice via our website www.nuyu-kas.com and notify you of events via email. Therefore, providing a valid email address and mobile number will be the best way for us to stay in touch when you’re not in the club.
ACKNOWLEDGMENTS AND DECLARATION
- Upon signing this from you confirm all the following:
- You did not have any surgery during the past 6 months
- You do not have diabetes T1D that requires insulin treatment
- You do not suffer from any contagious disease
- You confirm that there is no other reason why you should not exercise
- You do not suffer from any heart problem that requires taking medications
- You do not have any injuries in the bones or joints, back, hip, and knee problems
- You confirm that you never fainted
- I, voluntary agree to participate in physical activity, and I am fully aware of the possibility of health changes as a result. I am responsible for monitoring my physical and health condition during physical activity
- The guidelines of the usage of NuYu club’s premises and I accept any future rules and regulations
Your acceptance of the above Terms and Conditions is an electronic signature identical to the written signature on the Application Form.
